Mediation and Investigation
Best practice indicates that some form of mediation should take place to resolve issues prior to the expensive and depleting process of litigation.
Work place mediation is a cost effective early intervention to resolve issues, ensuring prompt and satisfactory resolution to both the employee and employer’s grievances. Mediation can be effectively exercised for any conflict situation for individuals and groups where disagreement is blocking progress. It allows the exploration of issues with dignity in a confidential environment giving both parties the space to express their concerns. It is often the last chance for both parties to influence the outcome rather than provide information for arbitration. Mediation empowers individuals and organisations to feel a sense of closure as any emotional barriers are validated and shifted by the process leaving both parties to move on after the event.

Should the issue presented be advanced and significant this panel of experts can also hold an independent enquiry or investigation. These processes have different levels of disclosure than mediation but this would be discussed in depth at the briefing stage to ensure clarity with all concerned.
